BlabNet Incorporated (aka BlabNet)

INTERNET DISPLAY

All videos and images displayed on the internet regarding this video are the property of BlabNet. Blabnet reserves the right to use any video and photography that it shoots for its own marketing purposes and promotion. BlabNet clients have unlimited rights to use the video as they like.
BlabNet reserves the right to modify, edit or decline to activate any videos on the BlabNet.com website. Client is granted a limited, nonexclusive right to create a "hypertext" link to this site as long is it does not portray BlabNet or any of its other products or services in a false, misleading, derogatory, or otherwise defamatory manner.

PRODUCTION

Production Material: Client will provide source material to BlabNet two weeks prior to filming date. Failure of Client to provide material may lead to non-production of the video.
If client fails to provide material for the video, BlabNet may, at its discretion, complete the video with information at hand from the client. Should there be a scheduling conflict of the studio or any other aspect of the production, BlabNet reserves the right to cancel the order or move to the next schedule date within a two month timeframe of the scheduled date.
No editing of the video: The one-minute spot is "self-contained" running from start to finish without any edits. Shooting is "Live to Tape" so that what is seen and heard at the moment is recorded and is what is going to be seen and heard on the final product.

DELIVERY OF FINISHED PRODUCT

Upon completion of the video, BlabNet will e-mail the video to the customer or webmaster if preferred with consent of the client. Video will be submitted to Client in a completed format. Client gives consent to BlabNet to have BlabNet logo on video.
In the event legal action is necessary to collect on balances due, client agrees to reimburse BlabNet for all expenses incurred to recover sums due, including attorney's fees and other legal expenses.

GENERAL INFORMATION

Independently contracted representatives provide services for BlabNet. Neither BlabNet, nor it's independently contracted service distributors are liable for any negligence, damages, or any wrongdoing on the part of the independent service representative.

LIABILITY– BlabNet will take the utmost care with respect to the production, postproduction and delivery of the video(s). However, in the event BlabNet or its independently contracted distributors fails to comply with the terms of this contract, due to any event at or beyond the control of BlabNet, including but not limited to illness, accidents, labor disputes, acts of God and other catastrophes (Hurricanes, Tornadoes, Earthquakes, Acts of Terrorism, etc.) or uncontrollable and unforeseeable equipment failure, BlabNet liability is limited only to refund of all monies received. Client holds harmless stockholders, officers and agents of BlabNet.

COPYRIGHT – Client and its agents agree to be responsible for all copyright clearance and release issues pertaining to the materials furnished to BlabNet for this video production. This material includes and is not limited to pictures, graphic material and objects used in the production of the video. Client warrants that material submitted to BlabNet does not infringe any copyright, patent or trademark. Materials that are trademark or copyrighted from third party sources must be authorized from the trademark or copyright owner if required. Client to provide BlabNet with documents upon request.

STOCK VIDEO – Client and its agents agree that BlabNet stock video may be used for internet website purpose. Client may not use or permit the use of Stock Video, or any part thereof, as a trademark or service mark, or claim any proprietary rights of any sort in the Stock Video. Client may not sell, sublicense, distribute or otherwise grant rights or make available for use by others all or a portion of the Stock Video in form or formats designed or intended for re-use or re-sale of the Stock Video. Stock Video is owned by BlabNet Incorporated and protected by United States Copyright Law and International Treaty provisions. Transfer - Client may not rent, lease, sub-license or lend the Stock Video, or any copy thereof, to another person or legal entity. Thumbnail image shown on BlabNet screen not included with video.

The terms and conditions are the sole understanding between BlabNet and the client. No other terms or conditions apply unless specified by contract.
